A popular tool when a Seller asks for “Highest and Best Offers,” escalation clauses can be an effective tool for buyers looking for a competitive advantage in negotiations.
This course will cover the basics of escalation clauses in general, and the NMAR escalation clause in particular. In the process, attendees will discuss escalation strategies and the ethical considerations of this approach.
